Policies for the Protection of Indonesian Migrant Workers from an Islamic Economics Perspective: An Analysis of the Principles of Justice and Humanity
Abstract
This study examines policies for the protection of Indonesian migrant workers through the framework of Islamic economics, with a focus on the principles of justice and humanity. Migrant workers are a vital asset to the national and global economies, yet they face various social, legal, and economic risks and vulnerabilities, including exploitation and human trafficking. The analysis examines national legal norms and regional instruments, and evaluates policy implementation based on the principles of maqāṣid al-sharī‘ah—such as ḥifẓ al-māl, ḥifẓ al-nafs, and ḥifẓ al-‘aql—which reveal gaps and challenges in the implementation of protection measures. In addition, the study adopted a systematic literature review (SLR) methodology to collect secondary data from official documents, institutional reports, and relevant scholarly articles. Through content and thematic analysis, it was found that although regulations have undergone positive changes, the reality on the ground still reveals a gap between norms and implementation. Therefore, this study recommends a Sharia-based economic policy model that emphasizes gender justice, the protection of human rights, and improved coordination among relevant actors to ensure comprehensive protection for Indonesian migrant workers.
