Abstract

This study examines the legal implications of international trade law in cross-border e-commerce transactions within the digital era. The rapid growth of digital platforms has transformed traditional trade mechanisms, creating complex legal challenges related to jurisdiction, applicable law, consumer protection, and dispute resolution. This research adopts a normative juridical approach, analyzing international legal frameworks, national regulations, and relevant legal doctrines governing cross-border digital trade. The findings indicate that existing international trade law instruments have not fully adapted to the dynamic nature of e-commerce, resulting in regulatory fragmentation and legal uncertainty. Issues such as the validity of electronic contracts, data protection, taxation, and the enforcement of cross-border judgments remain inadequately addressed. Furthermore, disparities in national legal systems hinder the effective implementation of uniform legal standards. This study highlights the urgency of regulatory harmonization and the development of adaptive legal frameworks to ensure legal certainty and fairness in international digital transactions. It also emphasizes the role of international cooperation in strengthening governance mechanisms for cross-border e-commerce. The research contributes to the discourse on modernizing international trade law in response to digital transformation, offering insights for policymakers, legal practitioners, and scholars in addressing emerging challenges in global electronic commerce.
